Fair Use Policy

Objective                                                                             

We want our customers to have the ability to utilize our services for self-expression and information sharing. However, we also recognize the importance of implementing specific guidelines to ensure:

• the protection of the safety and rights of all users and J-Servers

• that our services are not misused in any way that could compromise the quality of service for our customers. Our Fair Use Policy outlines these guidelines and the potential actions we may take in the event of a violation.

 

Clarifications

J-Servers - identifies J-Servers. (ABN: 64 156 562 037) operating under the name J-Servers

Customer - refers to all users of J-Servers, including both individual and business clients, as well as resellers and wholesalers

Services - encompasses all services offered by J-Servers, such as internet connectivity, calling plans, SIP Trunking, phone numbers, PBX capabilities, integrations, and more

Spam - denotes unsolicited electronic communications that contain an “Australian Link,” in line with the Spam Act 2003 (Cth)

You - the account holder and any persons authorized by the account holder to access their J-Servers account and services

 

Valuing others

It is forbidden to use our services for: 

•   inciting or threatening violence against any person 

•   harassing or abusing others, including making offensive, misleading, or threatening comments (this includes our staff) 

•   promoting hate, such as making racist, sexist, or discriminatory remarks 

•   posing a risk to the health or safety of any individual 

•   using our service to send unsolicited or unwanted commercial electronic messages (Spam) to individuals or businesses


Complying with legal regulations 

It is imperative that you refrain from utilizing our services for any illegal or unlawful activities. This encompasses, but is not limited to:

• submitting inaccurate account details

• unauthorized access to another individual's information

• distributing or facilitating the distribution of Spam, or violating the Spam Act 2003 (Cth)

• the transmission or storage of data that contravenes Australian laws, including but not limited to pornography and malware

• violating any relevant laws, including copyright infringement

 

Upholding the integrity of J-Servers and our suppliers 

It is imperative that our services are utilized in a manner that does not compromise the integrity of J-Servers' network, reputation, or customer relationships. This encompasses, but is not limited to:

• Engaging with our services in a manner deemed ‘prohibited’, ‘unreasonable’, ‘unacceptable’, or that surpasses ‘ordinary use’

• Redistributing our services or products to third parties without prior authorization

• Employing our services for purposes other than those for which they were designed

• Utilizing our services in a manner that may lead to interference, disruption, congestion, or generally diminished network performance

• Acting in a way that contravenes our wholesale agreements with third-party suppliers

 

Technology specific requirements

Furthermore, the following stipulations are applicable to particular services:

VoIP services:

The following activities may be classified as excessive or unreasonable use:

•   Automated dialing

•   Persistent or extensive call forwarding

•   Continuous connectivity

•   Fax broadcasting or unsolicited fax transmissions

•   Telemarketing activities (including charitable, political solicitation, or polling) 

•   Call center operations or elevated call volumes under unlimited business call plans 

•   Contacting or faxing individuals (via distribution lists or otherwise) who have not explicitly consented to receive such communications 

•   An answer seizure ratio (ASR) below 40% 

•   An average call length (ALOC) of less than 15 seconds

•   Customer inbound or outbound minutes exceeding 80% of the total usage of J-Servers customers

•   Customer's average minutes per call surpassing 90% of the total usage of J-Servers customers

•   Any patterns of improper usage 

•   Utilizing a PBX user license for multiple users

 

Prohibited activities include:

• Engaging in robocalling is strictly forbidden; failure to comply will result in immediate termination of your account.

 

SMS services:

Activities that may be deemed as inappropriate or excessive usage include:

• high-volume or bulk messaging

• sending unsolicited SMS communications

• transmitting messages that do not represent standard person-to-person exchanges

• application-to-person messaging

• issuing messages of a phishing or smishing nature, which involve attempts to solicit personal information and encourage recipients to respond via call or SMS

• disseminating messages related to access hacking, including the incorporation of malicious code or URLs

• impersonating established brands or institutions, including the alteration or imitation of sender identification

 

Phone number services:

Instances of activities that may be considered excessive use include:

• frequent or repetitive transfer of phone number ownership

 

Internet services:

Instances of activities that may be deemed as excessive or inappropriate use include:

• Utilizing internet services in a manner that results in, or has the potential to result in, interference, disruption, congestion, or generally diminished network performance.

• Engaging in (or attempting to engage in) any of the following actions without proper authorization:

• Disabling, disrupting, or interfering with the normal operation of any service or network, including, but not limited to, actions such as overloading, executing denial of service attacks, or flooding a network, as well as probing, scanning, or testing the vulnerabilities of a system or network, or breaching the security or authentication protocols of a service or network.

• Providing service to multiple premises through a single connection.


What are the consequences of violating this policy?

In the event that we suspect a violation of this policy, we reserve the right to take appropriate action.

This may include:

• conducting an investigation into the alleged breach (which may or may not involve communication with you)

• requesting modifications to your usage of our services

• issuing a formal notice of warning

• amending the terms of service applicable to your account without prior notification

• limiting your access to our services, with or without prior notice

• suspending or terminating your service, with or without prior notice

Should we determine that a legal infraction has occurred, we will notify law enforcement authorities and provide them with your personal information (for further details, please refer to our Privacy Policy).

             

Revisions to our fair use policy 

We maintain the authority to modify this policy regarding our services at any time. The revised version of this policy will take effect immediately upon its publication on our website. Your ongoing use of our services after such updates will be interpreted as your acceptance of these changes.
